Terms of Service

1. Scope

These Terms of Service ("Terms") govern the use of the mobile app "Terra Incognita" and the associated website the-terra-incognita.app (together "Service"), operated by:

By registering for and using the Service, the user accepts these Terms.

2. Description of Service

Terra Incognita is a mobile game in which real steps (measured via Apple HealthKit or Google Health Connect) are converted into game progress. The Service includes:

  • A mobile app for iOS and Android
  • Server-side game logic and data storage
  • An accompanying website

3. Registration and User Account

  • Using the app requires registration.
  • The user must be at least 18 years old.
  • The user is responsible for the security of their login credentials.
  • Only one user account per person is permitted.

4. Free Use and Full Version

4.1 Free Use

The core game is available free of charge: exploration, resource gathering, the full base camp, outposts, daily challenges, and the logbook. There is no limit on how far you walk, and walking is never blocked.

4.2 Full Version (one-time purchase)

  • The full version is an optional, one-time in-app purchase that permanently unlocks additional content (further landscapes and the research buildings).
  • It is not a subscription. There is no recurring charge and nothing renews automatically.
  • The price is shown in the Apple App Store or Google Play Store before purchase.
  • The purchase can be restored on your other devices through the respective store.

4.3 Right of Withdrawal

For the one-time purchase made through the Apple App Store or Google Play Store, the refund and withdrawal policies of the respective store apply. Requests must be processed directly through the store.

5. Health Data

  • The app reads step count data from Apple HealthKit or Google Health Connect.
  • Access only occurs after explicit consent by the user through the operating system's permission prompt.
  • The data is used exclusively to calculate game progress.

6. User Obligations

The user agrees to:

  • Not misuse the app.
  • Not manipulate or attempt to manipulate step count data.
  • Not perform automated access to the Service (bots, scraping, etc.).
  • Not exploit or distribute vulnerabilities of the Service.

In case of violations, we reserve the right to temporarily or permanently suspend the user account.

7. Availability

We strive to provide the Service with minimal interruptions. However, there is no guarantee of continuous availability. Maintenance, technical issues, or force majeure may lead to temporary restrictions.

8. Liability

  • We are fully liable for intent and gross negligence.
  • In cases of slight negligence, we are only liable for breaches of essential contractual obligations (cardinal obligations), limited to foreseeable, contract-typical damages.
  • Liability for damages resulting from injury to life, body, or health remains unaffected.
  • We are not liable for the accuracy of step count data provided by HealthKit / Health Connect.
  • Terra Incognita is a game, not a medical product. The app does not replace medical advice.

9. Intellectual Property

All content of the Service (texts, graphics, game mechanics, software) is protected by copyright. Use beyond the intended use of the app requires written consent.

10. Termination and Account Deletion

  • The user may delete their account at any time. Deletion can be requested through the app or by email to hi@the-terra-incognita.app.
  • Upon account deletion, all personal data and game data will be deleted within 30 days.
  • The full version is a one-time purchase tied to your Apple or Google store account. Deleting your game account does not refund it, and it can be restored through the store.

11. Changes to Terms

We reserve the right to modify these Terms. Users will be notified of material changes via email or in-app notification. Continued use of the Service after changes take effect constitutes acceptance.

12. Governing Law and Jurisdiction

The laws of the Federal Republic of Germany apply, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, the mandatory consumer protection provisions of the state in which the consumer has their habitual residence apply.

13. Severability

If any provision of these Terms is or becomes invalid, the validity of the remaining provisions shall not be affected.
